التكييف القانوني لعقد الاشتراك في شبكة الانترنت

Résumé: أضحت شبكة الإنترنت في الوقت الحالي المكان الأمثل للقیام بمختلف التبادلات والأعمال التجاریة، وأن هناك عقوداً ذات طبیعة خاصة أصبحت تبرم من أجل التأطیر القانوني لهذه التجارة الإلكترونیة التي ما فتأت تزداد یوما بعد یوم بفضل ما توفره الشبكة من إمكانیة التحاور والتفاوض ونقل المعلومات بین المستخدمین في شتى أرجاء العالم. ویتربع عقد الدخول إلى شبكة الإنترنت على رأس قائمة عقود خدمات الاتصال أهمیة وتنوعاً وأكثرها استعمالاً، لكونه المنفذ الأساسي للاستفادة من الحاسوب واستخدامه في مجال التجارة الإلكترونیة ومختلف الخدمات التي توفرها شبكة ،وبغیة الاتصال بالإنترنت ینبغي على المستخدم التعاقد للحصول على إمكانیة النفاذ إلیها مع مورّد خدمة الدخول لذا لا بدّ من ضبط التكييف القانوني لهذا التعاقد. The Internet has become at the present time the ideal place to carry out various exchanges and businesses, and that there are contracts of a special nature that have been concluded for the legal framework of this electronic commerce, which has been increasing day after day thanks to the network’s ability to dialogue, negotiation and transfer of information between users in various around the world. The Internet access contract is at the top of the list of communication services contracts, the most important and diverse and the most widely used, as it is the main outlet for benefiting from and using the computer in the field of e-commerce and the various services provided by the network. Therefore, it is necessary to adjust the legal qualification of this contract.
