إشكالات التنفيذ الموضوعية-منازعات السند التنفيذي

Résumé: إن تنفيذ المدين لالتزاماته المالية (ديونه) لا يثير في الواقع إشكالات قانونية، إلا أن امتناعه عن تنفيذ هذه الالتزامات يطرح مشكلة إجرائية للوفاء، وهنا إذا ماطل المدين في الوفاء بدينه فإنه يجب إجباره على هذا التنفيذ وذلك من خلال ما يصطلح عليه بالتنفيذ الجبري حفاظا على حقوق الدائن، وذلك إذا كان بيد هذا الأخير سند تنفيذي صادر وفقا لأحكام قانون الإجراءات المدنية والإدارية، إلا أنه عند تنفيذ هذا السند قد تعترض المنفذ بعض الإشكالات موضوعيا التي تنجم عنها منازعة تنفيذية يطالب فيها الخصم بالحكم نهائيا في أصل الحق وهو حكم موضوعي بصحة التنفيذ. The debtor’s implementation of his financial obligations (his debts) does not actually raise legal problems, but his refusal to implement these obligations poses a procedural problem for fulfillment. Here, if the debtor procrastinates in fulfilling his debt, he must be forced to perform this implementation through what is known as forced implementation in order to preserve his integrity. The rights of the creditor, if the latter has an executive document issued in accordance with the provisions of the Civil and Administrative Procedures Law. However, when executing this document, the executor may encounter some objective problems that result in an executive dispute in which the opponent demands a final ruling on the origin of the right, which is an objective ruling on the validity of the implementation.
