جريمة التهرب الضريبي

Résumé: يعتبر التهرب الضريبي من أهم المعوقات التي تواجه التطور الاقتصادي للدول بما تسببه من انخفاض في مداخيلها ومواردها، وبالتالي عدم قدرتها على تحقيق أهدافها السياسية العامة في مختلف القطاعات. ومع ذلك فإن التهرب الضريبي قد يكون مشروعا حين لا يشكل مخالفة للقانون، وقد يكون يكون غير مشروع وذلك في الحالة التي يعتمد فيها على طرق مخالفة لأحكام القوانين الضريبية، وبالتالي يشكل جريمة في مفهوم هذه القوانين. هذا المقال جاء من أجل البحث عن الكيفية التي عالج بها المشرع الجزائري ظاهرة التهرب الضريبي حين تشكل جريمة، وذلك من خلال بيان أركان جريمة التهرب الضريبي والعقوبات المقررة لها، وبيان مدى فعالية القوانين الضريبية في مكافحة التهرب الضريبي. The tax evasion is one of the most important obstacles limiting the economic development and growth of countries, resulting in a decline in their revenues and resources, and thus their inability to achieve their general political objectives in various sectors. However, tax evasion may be legal when it does not constitute a breaking of the law, and may be illegal in the case where it relies on ways contrary to the provisions of the tax laws, and therefore constitutes a crime in the sense of these laws. This article came in order to review how the Algerian legislator dealt with the phenomenon of tax evasion when it constitutes a crime, through the statement of the elements of the crime of tax evasion and the penalties prescribed for it, and the effectiveness of tax low in combating off tax evasion.
