التعليل المقاصدي وأثره في فقه النوازل -حاضرة توات نموذجا-

Résumé: ملخص: يهدف هذا البحث إلى معالجة قضية من أبرز القضايا التي تربط علم مقاصد الشريعة ببنيته التحتية الأصولية فإن هذا الفن قائم على الاستثمار في مبحث مهم من مباحث أصول الفقه وهو مبحث التعليل إذ إن إثبات مقاصدية أي حاضرة علمية، لينطلق من اهتمام فقهائها بفلسفة تبرير الأحكام الشرعية، وبيان مناطاتها الجزئية، ثم مقدرتهم بعد ذلك على ربط هذه المناطات الجزئية ـــ العلل الأصولية ــــ بأسرار التشريع وغاياته ومقاصده الكلية، ربطا نلامس من خلاله متانة العلاقة بين فروع الشريعة المتمثلة في الأحكام النوازلية، وبين كلياتها المتجسدة في حكمها ومقاصدها، لذلك فإن التعليل المقاصدي للنوازل التواتية؛ هو المدخل والأساس لإثبات مقاصدية هذه الحاضرة، وهو المنطلق لكل باحث يتشوف إلى تقصيد أحكام نوازلها ـــ تناولها من الرؤية المقاصدية ــــ فالقول بمقاصدية الحاضرة هو من توابع القول بأن فقهائها ذوو ملكات تعليلية. Abstract: Proving the objectives of any scientific institution stems from the interest of its jurists in the philosophy of justifying Sharia rulings and explaining their partial implications, and then their ability to link these partial implications - the fundamental reasons - with the secrets of legislation, its goals and overall objectives, in a way through which we sense the strength of the relationship between the branches of Sharia represented by the calculative rulings and its totalities. embodied in its ruling and objectives. Therefore, the intended reasoning for the coming calamities is the entrance and basis for proving the present objectives, and it is the starting point for every researcher, who seeks to understand the rulings of its calamities - approaching them from the Maqasid view - so the statement of present objectives is one of the consequences of saying that its jurists are endowed with explanatory abilities.
