مبدأ التقاضي على درجتين في منازعات الأحزاب السياسية في الدول المغاربية(الجزائر - تونس- المغرب)

Résumé: يعطي مبدأ التقاضي على درجتين الفرصة لأطراف النزاع من إعادة النظر فيه من جديد أمام قضاة الموضوع في الدرجة الثانية، لتدارك ما قد يقع فيه قضاة الدرجة الأولى من أخطاء، خاصة إذا كان الأمر له علاقة بالحريات السياسية كالحق في الترشح والانتخاب وتكوين الأحزاب السياسية. تباينت مواقف التشريعات المغاربية (الجزائر-تونس-المغرب) من مدى الأخذ بالمبدأ في منازعات الأحزاب السياسية، حيث تبنته بتفاوت وفي قوانين مختلفة، تحاول هذه الدراسة توضيح تنظيم هذا المبدأ في منازعات الأحزاب السياسية في هذه الدول وكيفية تطبيقه وإلى أي حد وفقت هذه التشريعات في اللجوء إليه. ABSTRACT: According to the principle mentioned in the title, parties to a dispute have the right to request a new judgment on the merits before a court of second degree so to rectify any errors committed on the first level, particularly if the dispute concerns constituting political parties or their political rights (voting and being a candidate…). Legislation concerning the matter in the Maghreb states (Algeria, Tunisia and Morocco) are different. This research study is intended to clarify the extent of the principle of double adjudication in the three mentioned countries theoretically and practically.
