إعمال المستهلك حق التراجع عن العقود الخدماتية البنكية الإلكترونية

Résumé: الحق في التراجع عن العقد ليس نتاجا لتنظيم التعاقد الإلكتروني وإنما مصدره التشريعات الاستهلاكية الهادفة إلى حماية المستهلك، وأساسه منح فرصة للمستهلك الذي تسرع في التعاقد دون تروي أو تفكير باعتباره طرف ضعيف في الجانب المعرفي والفني والضغط النفسي الذي تمارسه وسائل الدعاية المتطورة باستخدام تقنيات أساليب حديثة هذا من جهة من جهة أخري يكون المتدخل المتعاقد معه وهو البنك في مجال الخدمات البنكية الالكترونية التي يقدمها لزبائنه يتمتع بالقوة في مختلف المجالات الاقتصادية التقنية والفنية والقانونية بالإضافة إلى اعتماده على التقنيات الالكتروني الحديثة والمتطورة في إبرام العقود وتنفيذها. حماية للمستهلك من التسرع عند التعاقد لاسيما عن بعد وغياب الاتصال المادي بين المستهلك والبنك أقرت مختلف التشريعات الاستهلاكية والبنكية وحتى الإلكترونية حق المستهلك في التراجع عن العقد قصد حماية رضاءه تطبيقا لنظام العام الحمائي من جهة وإعادة التوازن القوي لعقد الاستهلاك الالكتروني من جهة أخري.
