حق المستهلك في العدول عن العقد الإلكتروني في التشريع الجزائري

Résumé: من أهم المشكلات المعاصرة التي تواجه المستهلك اليوم تلك المتعلقة بالمعاملات الإلكترونية لفئة المستهلكين عبر الأنترنت في إطار ما بات يعرف بالعقد الإلكتروني الذي يعد أهم وسيلة من وسائل التجارة الإلكترونية التي عادة ما يصاحب عرض السلع أو الخدمات في هذه السوق عبر الأنترنت الكثير من المبالغة في الدعاية. وباعتبار أن المستهلك في مثل هذا التعاقد لا يتمكن من معاينة السلعة أو التعرف على الخدمة عن قرب ما يجعل هذا الأمر يؤثر بشكل واسع على توجه المستهلك، وقد يوقعه في مغالطة تضر بمصالحه. ومن ث م يظهر القول بحق المستهلك في العدول (المادة 23 من قانون التجارة الإلكترونية الجزائري)، أو كما يسميه البعض الحق في التراجع عن العقد، كآلية حمائية إضافية للمستهلك الإلكتروني عن تلك المقررة في القواعد العامة. هذا الحق يخول للمستهلك الإلكتروني العدول عن العقد بعد إبرامه بإرادته المنفردة خلال مهلة زمنية محددة إما قانونا أو اتفاقا دون تحمل أي مصاريف إضافية باستثناء نفقات رد المبيع. الكلمات المفتاحية: عقد الاستهلاك؛ العقد الإلكتروني؛ حق العدول؛ المستهلك؛ حماية المستهلك؛ المستهلك الإلكتروني. Summary: One of the most important contemporary problems facing today's consumers is the electronic transactions of the online consumer category in the context of what has come to be known as the electronic contract, which is one of the most important means of electronic commerce. The supply of goods or services in this online market is usually accompanied by a lot of over-publicity. As a consumer in such a contract is unable to view the commodity or to identify the service in close proximity, this has a widespread impact on the consumer's orientation and may place him in a fallacy detrimental to his interests. Article 23 of the Algerian Electronic Commerce Act, or as some call it the right to renounce a contract, shows that the consumer's right to renounce is an additional protective mechanism for the electronic consumer than those established in general rules. This right entitles the electronic consumer to renounce the contract after it has been entered into at its own will within a fixed time limit, either legally or by agreement, without incurring any additional expenses except for restitution expenses.
