Résumé: إن الآثار التي تنشأ عن عقد ترخيص استغلال براءة الاختراع تحدد بعنصرين إثنين هما: المديونية والمسؤولية, وبمقتضى العنصر الأول يجب على المدين والذي هو هنا بمثابة (المرخص) بأن ينفذ التزامه بإرادته في مواجهة أحدهما بأداء واجبه تترتب على ذلك المسؤولية العقدية, ولأن الالتزامات على عقد الإيجار, فإنها تثير عديد الإشكالات القانونية, والتي سنتعرض لها بالدراسة والتحليل في هذا البحث. الكلمات المفتاحية: المرخص- المرخص له- الالتزامات الناشئة-عقد الترخيص-استغلال البراءة. Abstract: the effects arising from the patent licensing contract it is determined by two element , namely : Indebtedness and liability , under the first element the debtor must act as (the licensee) to run out of this commitment to his will against the creditor of the licensee , if one of them is in breach of his duty, and because the obligations arising on the license contract are similar to the obligations on the lease, they raise many legal problems , which will be exposed to study and analysis of this research.
