قاعدة الاصل في المعاملات الحل واثرها على حكم معاملات المصارف الاسلامية (نماذج مختارة)

Résumé: "تناولت هذه الدراسة موضوع: القاعدة الفقهية ""الأصل في المعاملات الحلُّ"" وأثرها على معاملات المصارف الإسلامية، نماذج مختارة( الحوالة المصرفية و تحصيل الأوراق التجارية)، وكان الإشكال الرئيسي: ما أثر القاعدة الفقهية"" الأصل في المعاملات الحلُّ"" في حكم المعاملات المصرفية؟ فأجابت الدراسة من خلال ثلاثة مباحث كالآتي: المبحث الأول تطرقت فيه إلى مفهوم القواعد الفقهية، تعريفها وأقسامها ومصادرها وحجيتها ومفاهيم حل المصارف الإسلامية ومعاملاتها،وأمّا المبحث الثاني فخصّصته للتعريف بقاعدة "" الأصل في المعاملات الحلُّ"" وبيان معناها وحجيتها، وجعلت المبحث الثالث لتطبيقات القاعدة فتناولت معاملتين ( الحوالة المصرفية و تحصيل الأوراق التجارية)، وشرحتهما وبينت أثر القاعدة على حكميهما. وتوصلت الدارسة إلى عدة نتائج ، أهمها:  تعتبر قاعدة "" الأصل في المعاملات الحل "" حجة يستدل بها في الفقه الإسلامي، وفقه المعاملات خاصة.  إن قيام المصارف الإسلامية بخدمات التحويل وتحصيل الأوراق التجارية ، تزيد من زرع الثقة وزيادتها لدى العملاء، وهو ما يدو الناس ويشجعهم على التعامل مع المصارف الإسلامية بدل المصارف التجارية. كما أوصت الدراسة بالاهتمام بدراسة القواعد الفقهية، وتطبيقاتها على معاملات المصارف الإسلامية، وخاصةً بعد بداية فتح نوافذ إسلامية في البنوك التجارية الربوية. الكلمات المفتاحية: قاعدة – الأصل - الحلّ- معاملات- المصارف الاسلامية ."This studydealtwith the subject of: the jurisprudentialrule ""the principle in the solution transactions"" and its impact on the transactions of Islamicbanks, selectedmodels (banktransfer and collection of commercial papers), and the main problemwas: Whatis the effect of the jurisprudentialrule ""the principle in the solution transactions"" on the ruling on banking transactions? The studyansweredthroughthree topics as follows: The first one dealtwith the concept of jurisprudence rules, itsdefinition, divisions, sources, authority and concepts of Islamicbanking solution and their transactions. As for the second topic, itdevotedit to the definition of the rule of ""the origin in the solution transactions"" and clarifieditsmeaning and authority. (Bank transfer and collection of commercial papers), and I explainedthem and showed the effect of the rule on theirrulings. The studyreachedseveralresults, the most important of which are:  The principle of ""the principle in transactions is the solution"" isconsidered an argument in the Islamic jurisprudence, and the jurisprudence of transactions in particular.  The factthatIslamicbanksperformtransfer services and collect commercial papersincreases the implantation of confidence and increasesthemamongcustomers, which leads people and encourages them to deal withIslamicbanksinstead of commercial banks. The studyalsorecommendedpaying attention to the study of jurisprudence rules and their applications to Islamicbanking transactions, especiallyafter the beginning of the opening of Islamicwindows in usurious commercial banks.
