النظام القانوني للسلطة العليا للشفافية والوقاية من الفسادومكافحته

Résumé: إن ظاهرة الفساد المستشرية والمتزايدة بسرعة دفعت المشرع الجزائري إلى سن آلية قانونية لمكافحة هذه الظاهرة، وتتجسد هذه الآلية في الهيئة العليا للشفافية والوقاية من الفساد ومكافحته، والتي تم إنشاؤها بموجب التعديل الدستوري لسنة 2020. حيث حدد القانون 22-08 تنظيم وتشكيل وصلاحيات الهيئة العليا، في حين يتعلق القانون 06-01 بالوقاية من الفساد ومكافحته. وقد منح المشرع الهيئة العليا مجموعة من الصلاحيات والمهام التي تمكنها من القيام بالعمل الموكل إليها، إلا أن هناك العديد من العوامل التي ساهمت في تقويض دورها في معالجة قضايا الفساد ومتابعتها. ونأمل أن تقوم الهيئة العليا بدورها بفعالية من خلال الإطار القانوني الذي منحها إياه التعديل الدستوري لسنة 2020The rampant and rapidly increasing phenomenon of corruption has prompted the Algerian legislator to enact a legal mechanism to combat this phenomenon. This mechanism is embodied in the High Authority for Transparency, Prevention and Fight against Corruption, which was established by the constitutional amendment of 2020. Law 22-08 specifies the organization, composition, and powers of the High Authority, while Law 06-01 relates to the prevention and fight against corruption. The legislator has granted the High Authority a set of powers and tasks that enable it to carry out the work entrusted to it. However, there are many factors that have contributed to undermining its role in addressing and following up on corruption cases. We hope that the High Authority will play its role effectively through the legal framework granted to it by the constitutional amendment 2020
