النظام القانوني للسلطة العليا للشفافية والوقاية من الفساد ومكافحته في ظل القانون 22-08

Résumé: كرست الدولة الجزائرية العديد من الوسائل القانونية بهدف التصدي لجرائم الفساد التي انتشرت بصورة كبيرة ومست باقتصاد الدولة، فكان على المشرع الجزائري إيجاد آليات قانونية للوقاية من هذه الجرائم ومكافحتها، وفي هذا الإطار تم إصدار العديد من القوانين هدفها مكافحة الفساد أهمها القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته، والذي نص على إنشاء الهيئة الوطنية للوقاية من الفساد ومكافحته وتم تكريسها دستوريا بموجب التعديل الدستوري لسنة 2016، وبموجب التعديل الدستوري لسنة 2020 تم ترقيتها لتصبح السلطة العليا للشفافية والوقاية من الفساد ومكافحته، وتم تنظيمها بموجب القانون 22-08 المتضمن تنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافحته وتشكيلها، والتي أصبحت مؤسسة رقابية بعدما كانت استشارية، وقد منح لها التعديل الدستوري لسنة 2020 صلاحيات واسعة.The Algerian state has devoted many legal means to tackle the corruption crimes, that has spread vastly and touched the state’s economy, for that the Algerian legislator had to find legal mechanisms for the prevention from these crimes and combating it, for this purpose the state has adopted many laws its objective combating corruption, and the most important law n 06-01 related to the prevention and fight against corruption, which provided the establishment of the national body for preventing and combating corruption, which was constitutionally enshrined in the constitutional amendment of 2016, and according to the constitutional amendment of 2020 it has a constitutional promotion and becomes the supreme power for transparency, prevention and combating corruption, moreover it is organized by law n 22-08 related to the organization of the supreme power for transparency, its competence that it become a supervisory institution after being a consultative institution which caved her an enlarger competences.
