السّياسة العقاريّة الفرنسيّة المعتمدة لتفكيك أراضي العرش في الجزائر (1873-1926)

Résumé: تهدف هذه الورقة البحثيّة إلى عرض وتمحيص السّياسة العقاريّة الفرنسيّة تجاه أراضي العرش في الجزائر خلال المرحلة ما بين 1873-1926 وهي جزء من فترة الحكم المدنيّ ضمن نظام حكم الجمهوريّة الثّالثة، حيث اعتمدت إدارة الاحتلال خلالها آليّات قانونيّة استهدفت بموجبها تفكيك أراضي العرش على غرار فترة الحكم العسكريّ السّابقة، فلم تتوقّف إدارة الاحتلال عن اغتصاب هذا الصنف من الأراضي بالرّغم من حلول الحكم المدنيّ محلّ الحكم العسكريّ. توصّلنا إلى نتيجة أساسيّة هي أنّ الغاية التّشريعيّة من تفكيك أراضي العرش تحقّقت على نطاق واسع، حيث تغيّرت في الحقيقة طبيعتها نتيجة لفرنستها وإخضاعها للمعاملات العقاريّة وتعطيل الأعراف التّقليديّة الّتي كانت تحكمها؛ ممّا ولّد آثارا سلبيّة على البنية الاقتصاديّة والنّسيج الاجتماعيّ للعشائر القائم على التّآزر في العمل والانتفاع بهذه الأراضي، وعلى الرّغم من ذلك فإنّ أراضي العرش لطالما شكّلت حصنا قويّا تجاه مختلف السّياسات العقاريّة الجائرة، وما تخبّط إدارة الاحتلال في اعتمادها لعديد الآليّات القانونيّة تجاه عمليّة تفكيكها إلّا دليل على صعوبة اختراقها. This paper aims to present and examine the French real estate policy towards the "Arch " lands in Algeria during the period 1873-1926 and is part of the period of civil rule within the system of the Third Republic. Where the occupation administration adopted legal mechanisms aimed at dismantling the "Arch "lands similar to the previous period of military rule, The occupation administration has not stopped usurping this type of land despite the replacement of military rule by civilian rule. We have reached the basic conclusion that the legal mechanisms adopted to dismantle the "Arch"lands achieved a large part of the legislative purpose, where in fact the nature of these lands changed as a result of the Français and subjugation of real estate transactions and the disruption of traditional customs that governed them; Which generated negative effects on the economic structure and social fabric of the clans based on cooperation and synergy in the work and use of these lands, but despite all this, the "Arch "lands has always been a strong bulwark against various unjust real estate policies, and what the occupation administration is confused in its adoption of many legal mechanisms towards the process of dismantling these lands Only proof it's hard to hack.
