السّياسة التّشريعيّة الفرنسيّة تجاه الأراضي الفلاحيّة في الجزائر (1830-1962)

Résumé: لم يكن الاحتلال الفرنسيّ للجزائر يهدف لاستغلال ثرواتها فحسب بل كان يجمع بين الاستغلال والاستيطان، وقد أرسى لتنفيذ سياسته الاستغلاليّة الاستيطانيّة سياسات عديدة مسّت هويّة الجزائريّين وعقيدتهم وممتلكاتهم، مستهدفا بذلك جعل الجزائر ملكيّة تابعة لفرنسا في شمال إفريقيا. ولمّا كانت الأراضي الفلاحيّة على مختلف أصنافها تشكّل في نظر الاحتلال عاملا جوهريّا وحاسما لتجسيد مشروعه الاستيطانيّ وإرساء دعائم استقراره، اعتمد للاستيلاء عليها ومصادرتها سياسة عقاريّة سرعان ما كشف فيها عن براثنه باستعمال القوّة العسكريّة، وعن أطماعه التّوسّعيّة بوضع تشريعات عقاريّة حاول من خلالها تقنين عمليّات الاستيلاء وإضفاء الشّرعيّة عليها تحت عناوين ومبرّرات عديدة . استهدفت هذه الدّراسة القانونيّة التّاريخيّة محاولة حصر أهمّ التّشريعات المعتمدة في تنفيذ السّياسة العقاريّة الفرنسيّة تجاه الأراضي الفلاحيّة وفق التّنظيم الّذي كانت عليه خلال فترة الحكم العثمانيّ للجزائر سواء كانت أراضي البايليك أو أراضي الملك وحتّى الأراضي الوقفيّة الفلاحيّة وأراضي العرش ذات الطّابع الزّراعيّ والرّعويّ، ومن ثمّ أبرزت عدوانيّة هذه التّشريعات وانعكاساتها الخطيرة على المجتمع الفلاحيّ الجزائريّ.
