آثار الإيجار من الباطن في الإيجارات التجارية

Résumé: ينشئ عقد الإيجار من الباطن عدة علاقات فيما بين الأطراف المتعاقدة (المؤجر، المستأجر الأصلي، المستأجر من الباطن)، الأمر الذي يتطلب دراسة النظام القانوني الذي يحكم هذه العلاقات بهدف تحديد شروطها والآثار المترتبة عن كل علاقة منها، وذلك من أجل معرفة مدى توفيق المشرع الجزائري في تنظيمها بشكل يحقق التوازن بين مصالح الأطراف المتعاقدة، غير أن ما لاحظناه في هذه الدراسة أن المشرع لم ينظم الآثار المترتبة على عقد الإيجار من الباطن تنظيما شاملا وكافيا. The sub-lease contract creates several relationships between the contracting parties (the lessor, the original tenant, the sub-tenant), which requires studying the legal system that governs these relationships in order to determine their conditions and the implications of each relationship, in order to know the extent of the Algerian legislator's success In its organization in a way that achieves a balance between the interests of the contracting parties, however, what we noted in this study is that the legislator did not comprehensively and adequately regulate the effects of the sub-lease contract.
