الاختيارات الفقهية عند الامام محمد الطاهر بن عاشور من خلال كتابه: "كشف الــمُــــغَطَّى من المعاني والألفاظ الواقعة في الموطأ"

Résumé: "هذه الرسالة المعنونة بالاختيارات الفقهية عند الطاهر ابن عاشور من خلال كتابه ""كشف المغطى من المعاني والألفاظ الواقعة في الموطأ"" كان الإشكال الرئيسي فيها: ماهي اختيارات الطاهر ابن عاشور الفقهية؟ وماهي تجليات ذلك في كتابه كشف المغطى؟ وقد عالجت الدراسة هذا الإشكال في فصلين: ففي الفصل الأول تطرقت إلى ترجمة الامام مالك والطاهر ابن عاشور رحمهما الله تعالى، لتتطرق في الفصل الثاني إلى اختيارات ابن عاشور في كتابه ""كشف المغطى"" بنماذج مختارة، تناولتها بعض المسائل من باب العبادات ثم الأحوال الشخصية ثم المعاملات المالية لتَخْلُص في الأخير إلى بيان أهمِّ النتائج الـمُتَوَصَّلِ إليْها."This dissertation, entitled The Fiqh Choices of Al-Tahir Ibn Ashour through his book Kashf Al-Mushta’ of Meanings and Words Occurring in Al-Muwatta, the main problem in which was: What are Al-Tahir Ibn Ashour’s jurisprudential choices? What are the manifestations of this in his book Uncovering the Covered? The study addressed this problem in two chapters: In the first chapter, I touched on the translation of Imam Malik and Al-Tahir Ibn Ashour, may God Almighty have mercy on them. In the second chapter, I touched on Ibn Ashour’s choices in his book “Kashf Al-Mukta’” with selected examples. It dealt with some issues from the chapter of worship, then personal status, then financial transactions, concluding in the end with a statement. The most important results reached
