المرسوم كآلية للتشريع في المنظومة القانونية الجزائرية

Résumé: يتناول هذا البحث المرسوم كأداة قانونية، تنوع بتنوع رئاسة السلطة التنفيذية، سواء في المراحل الانتقالية، أو المراحل العادية، حيث استعملت عبارة "المرسوم" واستعمل "المرسوم التشريعي" وبخاصة في عهد المجلس الأعلى للدولة، ثم إنّه بعد أن صارت السلطة التنفيذية تسير برأسين – بعد تعديل الدستور في 1988- شاع استعمال المراسيم الرئاسية أي المراسيم التي يصدرها رئيس الجمهورية، سواء المراسيم الرئاسية التنظيمية أو المراسيم الرئاسية الفردية، وكذلك "المراسيم التنفيذية" وهي التي يصدرها رئيس الحكومة أو الوزير الأول وتأتي تنفيذا للقانون أو التنظيم (التنظيم التنفيذي)، وتنقسم إلى قسمين مراسيم تنفيذية تنظيمية أو مراسيم تنفيذية فردية. This research deals with the “Decree” as a legal tool, and it’s diversity by the presidency diversity of the executive authority, whether in the transitional stages, or regular stages. They use the term "Decree" and use the "Legislative Decree" especially in the era of the Supreme Council of the state. Furthermore, after the Constitution amendment in 1988 the executive power became driven double-headed. Then, the use of presidential decrees “any decrees issued by the President of the Republic popularized” was commonly used. Whether regulatory presidential decrees, or individual presidential decrees. As well as “Executive decrees” which is issued by the Prime Minister or the head of the government and it comes as a law or regulation (Executive Management).It is divided into two executive decrees organizational or individual executive decrees.
