خصوصية إجراءات الضبط القضائي في جرائم التمييز وخطاب الكراهية وفق القانون 20-05

Résumé: تكفل غالبية دول العالم وفق منظوماتها القانونية الجزائية سواء كانت ذات طبيعة موضوعية أو ذات طبيعة إجرائية توفير الحماية القانونية لهوية الأشخاص والجماعات، وكل ما يتصل بها سواء كان الدين أو الإثن أو العرق أو اللون أو النسب أو اللغة أو الأصل القومي، وذلك من خلال تجريم أي تمييز أو خطاب كراهية يكون موجها ضد أي فئة أو أقلية تبعا لطبيعتهم حفاظا على تماسك المجتمع، ولأن كان ارتباط تلك الجرائم عادة ما يحاول مرتكبيها نشرها والدعوة إليها بطرق حديثة بغية التستر وإخفاء هويتهم، فإن إجراءات ضبطهم ومتابعتهم تكتسي طبيعة خاصة تتلاءم مع طبيعة الجرم المرتكب. وبالتالي فإن توفير الحماية اللازمة للمجتمع من تلك الجرائم لا يتأتى إلا ضمن منظومة إجرائية خاصة تمكنها من تعقب المجرمين أو المشتبه في ارتكابهم للجرائم بطرق حديثة، وذلك ما حرص المشرع الجزائري على توفيره في نص القانون 20-05 الخاص بالوقاية من التمييز وخطاب الكراهية ومكافحتهما تحقيقا لذات الهدف. The majority of the countries of the world, through their penal legal systems, whether of an objective or procedural nature, guarantee the provision of legal protection for the identity of persons and groups, and everything related to them, whether it is religion, ethnicity, race, color, lineage, language or national origin, by criminalizing any Discrimination or discourse that is directed against any group or minority according to their nature in order to preserve the cohesion of society, and because the perpetrators of these crimes usually try to spread and advocate for them in modern ways in order to conceal their identity, the procedures for their arrest and follow-up have a special nature that is compatible with the nature of the crime committed. Consequently, providing society with the necessary protection from these crimes can only be achieved within a special procedural system that enables it to track down criminals or those suspected of committing crimes by modern methods.
