مقال: نظام مسؤولية الدولة عن أعمال الضبط الإداري وأساس تطبيقاتها Articl : System Of State Responsibility On Administrative Control Work And Basis Of Its Application

Résumé: نستطيع القول أن من واجب الإدارة عند ممارستها لصلاحياتها في مجال الضبط الإداري أن تجد نوعا من المواءمة بين متطلبات الحفاظ على النظام العام وبين ممارسات الأفراد التي كفلها القانون إلا أن ذلك لا يعفي الدولة من مسؤوليتها و كذا تعويض الأفراد عن أضرار التي أصابتهم من خلال مباشرتها لوظائفها. و من هذا القبيل يأتي دور المشرع والقضاء الجزائري في الإقرار بتأصيل مسؤولية الدولة عن أعمالها المادية المشروعة و الغير مشروعة في حفظ النظام العمومي على أساس نظرية الخطأ و كذا المخاطر وتبيان أهمية قانون المصالحة في إرساءها من ناحية التطبيقات القضائية في الظروف العادية والاستثنائية. We can say that the duty of the administration when practicing its authorities in the field of administrative controle is to make a balance between requirements of keeping general order and individual practices which the law guarantee. However, this does not exempt the state from its responsibility, in addition compensate people for damages which affect them through initiating its function. From here comes the role of the legislator and the Algerian judiciary in recognizing the authentication of state responsibility on its concrete licit works and illicit ones in keeping general order based on the theory of error also risks, showing the importance of reconciliation law in anchoring it from the side of judiciary applications in ordinary and exceptional circumstances.
