المصطلح الفقهي بين تعدد اللفظ وتباين المعنى -نماذج مختارة-

Résumé: يعدّ القرآن الكريم أهمّ مصادر التشريع الإسلامي، والمنهل الأوّل الذي تُستمدّ منه الأحكام الشرعية والمصطلحات الإسلامية، وعلى هذا الأساس فقد سلط هذا المقال الضوء على قضية شغلت كثيرا من الباحثين مسّت المصطلح العلمي الحديث، وهي تعددية المصطلحات، التي كانت نتيجة الترجمة والتعريب، وغيرها وتم التركيز على مصطلحات الفقه الإسلامي باعتباره فنّا تراثيا شريفا، تميّز بخصوصية وضع مصطلحاته، حيث إنّ بعضها توقيفي من القرآن الكريم أو من السنة النبوية المطهرة، وبعضها الآخر نتيجة تواضع علماء الفقه على اختلاف مذاهبهم، أو حتى تفرّد بعضهم في عملية الوضع. Abstract: The Quran is considered as the most important sources of Islamic legislation, and is the first source on which is derived from Islamic rulings and Islamic terminology. On this basis, this article will shed light on an issue that has preoccupied many researchers. The modern scientific term is the pluralism of terminology, which was the result of translation and Arabization. Focus on the terms of Islamic jurisprudence as an art of honest heritage, characterized by the specificity of the development of terminology, as some of them stop from the Koran or the Sunnah of the Prophet and some of the other result of humility scholars of jurisprudence of different doctrines.
