Résumé: أصبحت السوق الإلكترونية ملاذا مهما للمستهلك الإلكتروني على المستوى العالمي، يلجأ إليهالإبرام الكثير من العقود والتي من بينها عقد البيع الإلكتروني، ونظرا للطبيعة الخاصة لهذا النوع منالعقود تم دراسة أحكام عقد البيع الإلكتروني من حيث تعريفه وبيان خصائصه أركانه واطرافه وتمييزه عن بعض العقود،استنادا إلى النصوص القانونية المنظمة للتجارة الإلكترونية. وتوصلنا إلى أن عقد البيع الالكتروني لا يختلف في تكوينه عن عقد البيع التقليدي، من حيثتوافر أركانه المتمثلة في الرضا والمحل والسبب هذا فيما يخص أركانه الموضوعية، وهو كذلكيتطلب أركانا شكلية المتمثلة في الكتابة والتوقيع الإلكترونيين. ونظرا لكون عقد البيع الإلكتروني من العقود الملزمة لجانبين فهو يرتب التزامات متقابلة بينطرفيه فيلتزم البائع بتسليم ونقل ملكية الشيء المبيع أما المشتري فيقع على عاتقه الالتزام بالدفعالإلكتروني والالتزام بتسلم المبيع. الكلمات المفتاحية:البيع الإلكتروني، الإيجاب الإلكتروني، القبول الإلكتروني، الكتابة الإلكترونية. Summary : The Electronicmarket has become an important haven for the electronic consumer globally, resorting to It to concludemanycontracts, including the electronic sales contract, and due to the special nature of this type of contract the provisions of the e-sales contract have been studied in terms of definition and statement of itscharacteristics and itspillars and distinguishing it from other contract,based on the legaltextsgoverning e-commerce.
