Résumé: ملخص: يعد مبدأ سلطان الإرادة من النظم الثابتة في معظم النظم القانونية ويقصد به أنه يكفي توافق إرادتين لإنشاء الالتزام، أي لانعقاد العقد، وإن إرادة المتعاقدين هي التي تحدد مدى الالتزامات التي يرتبها العقد أي أن معناه حرية الإرادة في إنشاء العقود وفي تحديد أثارها، ويهدف هذا البحث إلى بيان المقصود بهذا المبدأ في النظم القانونية المعاصرة وكذلك في الشريعة الإسلامية، ولما له من أثر على العقود. كلمات مفتاحية: سلطان الإرداة ، العقد، الشرط. Abstract: The principle of willpower is an established system in most legal systems and is intended to be sufficient for the compatibility of two wills to establish the obligation, i.e. to conclude a contract.
