الطبيعة القانونية للاثراء بلا سبب

Résumé: يعتبر الاثراء بلا سبب من مصادر الالتزام في القانون ، وتتحقق واقعة الاثراء بلا سبب عنداقتناء ذمة شخص وتتسبب بافتقار ذمة شخص آخر من دون مبرر قانوني مع وجود علاقةسببية.حيث تحكم هذه النظرية أربعة قواعد او نظريات حسب آراء الفقهاء، وحتى يتحقق الاثراء بلا سبب يجب ان تتوفر عدة شروط ، فلا يمكن تحققه في حال تخلف احد تلك الشروط ، ولا يمكن اثباته بدونها،.وبالرغم من سهولة المصطلح الا انه يوجد صعوبة بالغة في تحديد وقوعه وتحققه لأنها تتمتع بالغموض وصعوبة الاثبات، فتلتزم عملية قيام الدعوى بعوامل تم توضيحها في البحث. Enrichment without reason is considered one of the sources of obligation in the law, and the fact of enrichment without reason is achieved when a person is acquired and causes the loss of another person without legal justification with the existence of a causal relationship. As this theory is governed by four rules or theories according to the opinions of the jurists, and in order to achieve enrichment without reason, several conditions must be met.
