القضاء الرياضي الدولي ودوره في حل المنازعات الرياضية

Résumé: تنشأ العلاقات القانونية في نطاق ممارسة الألعاب الرياضية منازعات وبهذا تعيق ممارسة الرياضة، لهذا استوجب وجود آلية قانونية للحد من هذه المنازعات، لذلك وجب وجود قضاء متخصص لقصر امكانيات القضاء العادي في حل منازعات في المجال الرياضي، وباتساع نطاق النزاع الرياضي الذي كان مقتصرا في مجاله الداخلي ومنه هنا أصبح إنشاء محمكة التحكيم الرياضية الدولية أمرا ضروريا بالرغم من بدايتها المحتشمة إلا أنه بفضل إنجازاتها أصبحت هيئة قضائية تفصل المنازعات كدرجة ابتدائية وحالات أخرة كدرجة استئناف وتعززت مكانتها كونها تلعب دورا هاما في حل المنازاعات الرياضية في المجال الرياضي بصفة عامة وبمجال مكافحة المنشطات وعقود تحويل اللاعبين بصفة خاصة. Large disputes arise from relationships within the scope of the practice of sports and them impede the course of sports there for it was necessary to have specialized judiciary to resolve these disputes, it become necessary to be specialized judiciary. As the scope of the sporting disputes crpanded it become necessary to establish the court of arbitration of sports dispiste its modest start and not being recognized by the federations. However it's position has been strengthened by the fact that it plays an important role in resolving disputes in the field of sports in general anti-doping and player transfers contract in particular.
