Résumé: This study aims to highlight the importance of e-tourism which is the result of the scientific and technological mutation that has affected all the transactions which has led to the nodal imbalance, where it has granted more power to the owners who in position of economic strength by reason of their monopolization of technical information. The field of tourism is as the other field has undergone changes compared to the past, now the transaction made with the electrical support. The tourist companies have concluded electronic tourism contracts with the tourist as an electronic consumer via their virtual site, without the need to deal directly with him, and this contractual relationship which brings them together may entail different and mutual obligations. The most important are those incumbent on the tourism company, which constitute guarantees imposed by the Algerian legislator to ensure legal protection, that accompanies the tourist through the various stages of the contract, since he is the weakest party in this relationship because he ignores all the details and the tourist enters into the contractual relationship according to the contact details, that he obtains from the tourist companies.
