التنظيم القانوني للعمليات المصرفية الإسلامية

Résumé: تهدف هذه الدراسة إلى ابراز أهم العمليات المصرفية التي تقوم بها البنوك الإسلامية في الجزائر، والتي تلعب دورا مهما في تحريك عجلة التنمية الإقتصادية والإجتماعية، بما يقوم به من تجميع المدخرات من الجمهور ثم إعادة توظيفها، من خلال عمليات مصرفية مع عملها بما يساهم في استثمار الأموال وتفعيل السياسة الاقتصادية،باعتبار أنها لا تتعامل بالفائدة وهذا ما يعزز ثقة الجمهور في التعامل معه، فقد تم صدور نظام بنك الجزائر رقم 20-02المؤرخ في 15مارس2020 المحدد للعمليات البنكية المتعلقة بالصيرفة الاسلامية وقواعد ممارستها من طرف البنوك والمؤسسات المالية اد تضمن أهم العمليات المصرفية ذات الصيغة الاسلامية والتي جاءت على سبيل المثال لا الحصر، الأمر الذي نصت عليه المادة 4 من نظام 20-02. This aims to highlight the most important banking operations carried out by Islamic banks in Algeria, which piay an important role in moving the wheel of economic and social development, , by collecting savings from the public and then re-employing them, through .Banking operations with thrir work which contributes to investing money and activating economic policy, Considering that it does not deal with interest, and this enhances the public’s confidence in dealing whth it the bank of Algeria regulation No 20-02 dated March 15,2020, which which specifies banking operations related to Islamic banking and the rules for its practice by banks and financial institutions, was issued.It included the most important banking operations of an islamic format that came on for example, but not limited to, the matter stipulated in Article 4 of Regulation 20-02.
