Résumé: ملخص: تتعلق بتركة الهالك بعد وفاته العديد من الحقوق التي يتعين تنفيذها قبل قسمة الباقي من تركته على ورثته، ذكرها المشرع في مادة واحدة هي المادة180من قانون الأسرة الجزائري في باب الحقوق المتعلقة بالتركة. والحقوق المتعلقـة بالتركة في القانون الجزائري أربعة هي: مؤن تجهيزه، ديونه، وصاياه، و حقوق الورثة في الميراث، و هي ذاتها الحقوق المتعلقة بالتركة في الفقه الإسلامي . و سيتم في هذه الدراسة توضيح هذه الحقوق و كيفية استخراجها منها. Summary ; Many rights are attached to the estate of a deceased person after his death, witch must be executed before dividing the rest of the estate among the heirs of the deceased. These rights are mentioned in article 180 of Algerian Family Law. There are four rights attached to the estate of a deceased person in Algerian Law ; Funeral Expenses ,Debts ,Legacies, and Inheritance, and it’s the same rights in Islamic Fiqh. In this study , I will explain these rights , and the method of extracting them from the estate .
