Résumé: التقادم المكسب يعد آلية قانونية من أجل اكتساب الملكية العقارية عن طريق حيازتها لمدة معينة، حيث ينبغي شهر هذه الملكية أمام المحافظة العقارية وذلك قصد حمايتها من التعدي وكذا إعلان الغير بما يتعلق بالعقار الذي قد يكون محل نزاع أمام القضاء، الأمر الذي يجعل من المدعي بالحق في الملكية العقارية إثبات ادعائه أمام القاضي المختص بالفصل في المنازعة، غير أن هذا الأمر أي شهر الملكية العقارية المكتسبة بالتقادم يختلف باختلاف النظام المعتمد في الشهر داخل الدولة إذا تعلق الأمر بنظام الشهر الشخصي أو كان يتعلق بنظام الشهر العيني. الكلمات المفتاحية : التقادم، المكسب، الشهر الشخصي، الشهر العيني، الحيازة. Abstract: Prescription acquisitive is a legal mechanism for acquiring real estate ownership through possession for a certain period, where this ownership should be declared before the real estate governorate in order to protect it from infringement, as well as announcing to others regarding the real estate that may be in dispute before the judiciary, which makes the plaintiff the right to real estate ownership is to prove his claim before the judge competent to decide the dispute, but this matter, i.e. the declaration of real estate ownership by prescription, varies according to the system adopted within the country if it is related to the personal advertising system or it is related to the system of real advertising. key words: the prescription, acquisitive, the personal advertising, the real advertising, the ownership.
