اشتراط الشهادة الطبية وأثرها في عقد الزواج على ضوء قانون الأسرة الجزائري The Requirement Of Medical Certificate And Its Impact On The Marriage Contract In The Light Of Algerian Family Law

Résumé: إن إجراء الشهادة الطبية قبل الزواج من الموضوعات الفقهية والقانونية المعاصرة ذات الأثر البالغ في حياة الإنسان ومستقبل الأجيال القادمة، خاصة أنها تطرح جملة من الإشكالات رغم أن القانون يؤكد على ضرورة القيام بها من طرف الزوجين لإتمام عقد الزواج، وإقرار مثل هذا الإجراء جاء من منطلق الحفاظ على الصحة العمومية ووضع حد للتدليس المحتمل الوقوع عبر اكتشاف أمراض يمكن أن يعاني منها أحد الطرفين أو كلاهما أو وجود عيب من العيوب الذي يسعي أحد الطرفين لإخفائه، لأن الكثير من الأمراض الوراثية باتت تنتشر في المجتمع جراء ذلك، مع النقص الواضح في وعي أفراد المجتمع في التعامل والالتزام بالشهادة الطبية، ومنه جاءت هذه الدراسة لتبيان أهمية ومركز الشهادة الطبية في عقد الزواج. Abstract: Having a pre-marital medical certificate is one of the jurisprudnetial and legal contemperary subjects that have a tremendous impact on the human life and the future of the next generations. Particularly because it bears a set of problems, although the law affirms that is necessary for both groom and bride to do it in order to accomplish the marriage contract. The statement of such procedure came from a standpoint to protect the public health and put an end to the possibly happening frauduelent, through diagnosting the illnesses that one or both of them may possibly have, or the existence of a flaw that one of them is seeking to hide, bcause many genetic diseases are spreading all over the society as a result of that and with the evident lack of conciousness in society members in dealing and adhearing to the medical certificate in the marriage contract.
