مكانة و أثر أحكام تضامن الكفلاء بين أوجه التطبيق في القانون المدني و الشريعة الإسلامية The Status And Impact Of The Provisions Of The Solidarity Of The Sponsors Between The Aspects Of Application In Civil Law And Islamic Law

Résumé: إن دراسة نظام تضامن الكفلاء من المواضيع الأكثر أهمية،بحيث تهدف هذه الدراسة إلى تأمين الوفاء بالدين،و تبيان مكانة هذا النظام سوءا من الناحية القانونية أو الشرعية،فقد تم التطرق لتصور عام عن نظام التضامن لتعدد الكفلاء و تفريده عما يتشابه معه من أنظمة أخرى،و بشكل أكثر تفصيل تناولنا أحكام التضامن لتعدد الكفلاء في إطار القانون المدني،أما القسم الثاني من الدراسة فتم مناقشة أحكام التضامن لتعدد الكفلاء من منظور الفقه الإسلامي،و مسائل المتعلقة بانقسام الدين ومسألة الرجوع و تعدد الفروض عند تعدد الكفلاء و تضامنهم،و بذلك فإن المبادئ التي يقوم عليها هذا النظام في أحكامها العامة من وجهة القانون المدني لا تتنافى مع ما هو مقرر في الحكم الشرعي. The study of the solidarity system of sponsors is one of the most important topics, so that this study aims to secure the fulfillment of the debt, and to show the status of this system worse in legal or legal terms. In more detail, we dealt with the provisions of solidarity for the multiplicity of guarantors within the framework of the civil law. As for the second section of the study, the provisions of solidarity for the multiplicity of guarantors from the perspective of Islamic jurisprudence were discussed, and issues related to the division of religion and the issue of recourse and the multiplicity of assumptions when the multiplicity of guarantors and their solidarity, and thus the principles On which this system is based, in its general provisions from the point of view of civil law, it does not contradict what is stipulated in the Sharia ruling.
