عــقد رهـن العـلامة التجارية في التشريع الجزائري

Résumé: قد يلجأ صاحب العلامة التجارية، ومن أجل الحصول على الأموال اللازمة لتطوير تجارته، و مواكبة التطور التكنولوجي في الميدان الصناعي، وتوسيــع شبــكته التجارية إلى تـقديــــم العلامة رهنا لضمان هذا الدين الذي عليه، سواء تم ذلك أمام مؤسسات مالية عامة كانت أم خاصة، أو لدى الخواص، فيسمى في هذه الحالة المدين الراهن، هذا من ناحية، ومن ناحية أخرى قد يلجأ صاحب العلامة إلى تقديم علامته كرهن ليس لفائدته، بل يقدمها ضمانا لديون الغير و في هذه الحالة يسمى الكفيل العيني، وعليه تطبق الأحكام العامة للرهن الحيازي للمنقول على للعلامة باعتبارها مال منقول تخضع لأحكام هذا الرهن.
