مظاهر المرونة في عقد رهن العلامة التجارية.

Résumé: يعد الرهـن من أهم التصرفات الواردة علـى العلامات التجارية ، وتـأتي هذه الأهمــية من خلال مظاهر المرونة التي تتناسب مع خصوصية العــلامة ، مما زاد مـن أهميتها في عالم التجارة وجعلها من أقوى أدوات الائتمان المالي . يهدف هــــذا البحث إلى بيان مظاهــر المرونة التي يتميز بها عقد رهـــــن العلامة التجارية ، بعضها متعلق بالعلامة في حد ذاتها كوقــوع الرهـــن على العلامــــــــة سواء كــانت مــــدمـــــــجة مع المحل التجاري كعنصر مـــــــن عـناصره المعـنــويــة،أو كانت مســتقلـة عنه ووقــوع عقد الـرهــــــــن عـلى كل ما تـغطـيه العلامة مــــن السلع و الخـدمات ، أو على جـــــــــزء منها فـــقــط ؛ وبعض مظاهر المرونة الأخرى متعلق بأطراف العقد ،وأهم تلك المظاهر هـــو بقاء الـعــلامة التجارية تــحت تصرف المدين الراهن دون نـقـل حيازتـها إلى الدائن المرتهن خروجا عن القواعد العامة ،مع ما تمنح هذه المرونة لعقد رهن العلامة مـــــن مواءمة للحياة التجارية المعاصرة القائمة على مرونة الإجراءات وسرعتها . Mortgage is one of the most important behaviors relating to trademarks and this importance results from the flexibility associated with the specificity of the trademark , which has increased its importance in the world of trade and made it one of the most powerful guarantee instruments. This research aims to demonstrate the flexibility that characterizes the trademark mortgage contract, some of which are related to the mark in itself, such as the occurrence of the pledge on the mark, whether it was merged with the commercial shop as one of its intangible elements, or it was independent of it and the signature of the pledge contract of each of the goods covered by the mark. Services, or only a part thereof; Some other manifestations of flexibility are related to the contract parties, and . the most important of these aspects is that the trademark remains at the disposal of the current debtor without transferring its possession to the mortgagee in contravention of the general rules, with what gives this flexibility to the trademark mortgage contract in line with contemporary commercial life based on the flexibility and speed of procedures.
