قاعدة (الاحتياط للأبضاع أولى من الأموال) وتطبيقاتها عند المالكية باب الطلاق أنموذجا

Résumé: ملخص: الاحتياط من قواعد الشريعة الإسلامية التي اعتمدها الفقهاء وبنوا عليها الكثير من الفروع الفقهية، يُعمِلُه الفقيه فيما احتمل الوجهين، فيأخذ بأوثق الوجوه وبما هو أبعد عن شوائب التأويلات لإزالة الشك والريب والوقوف عند حدود الله تعالى، وقد اعتمده المالكية وتوسعوا في العمل به مثلما توسعوا في العمل بقاعدة سد الذرائع في كل أبواب الفقه. وقد ظهر ذلك جليا في باب الطلاق، حيث نجد أن المالكية قد بنوا الكثير من مسائل الطلاق على أصل الاحتياط فحكموا بلزوم ثلاث طلقات فيها، كلُّ هذا احتياطا للفروج وصونا لها عن مواقعة الزنا عملا بقاعدة (الاحتياط للأبضاع أولى من الأموال). Abstract : The precaution is one of the rules of Islamic science that the jurists have adopted and based many branches of jurisprudence upon، The jusist applies when there are two aspects (dilemma case)، so he takes the most reliable and respectful choice (aspect) in order to remove doubt and stand within the limits of Islam، This principle of precaution is used widely on different sections of jurisprudence like the rule of blocking pretexts. For instance، it is demonstrated in the chapter of divorce; where we find that the jurists based many divorce issues under the principle of precaution، so they ruled triple divorces are necessary under the rule of precaution، This to be a precaution for the private parts and to save from sexual intercourse (adultery)، And this in accordance with the rule of (the precaution for the private parts is more important than money).
