خصوصية أحكام المسؤولية المدنية المهنية في التشريع الجزائري

Résumé: شهدت المسؤولية المدنية المهنية نقاشات فقهية وقضائية هامة، وذلك راجع لأهمية المركز القانوني للمهني الذي يفترض فيه درجة عالية من الحرص بحكم تخصصه، فاتجهت جهود الفقه والقضاء لإبراز خصوصية هذه المسؤولية وتوسيع نطاقها احتراما لمقتضيات المهنة، لاسيما مع زيادة التركيز على الدور التعويضي لجبر الأضرار، لذلك أقر المشرع الجزائري إلزامية التأمين على المسؤولية المدنية المهنية. Professional civil liability has been the subject of significant doctrinal and jurisprudential debates, due to the importance of the legal status of the professional, who is supposed to demonstrate a high degree of diligence given his specialization. Doctrinal and jurisprudential efforts have been directed towards highlighting this liability and broadening its scope in accordance with the requirements of the profession, particularly the emphasis on the compensatory role to repair damages, which led the Algerian legislator to impose professional civil liability insurance. key words: Liability - the liberal profession - fault - compulsory insurance - compensation
