الضوابط الفقهية للتعامل مع الأسرار الطبية المتعلقة بالمعلومات الوراثية

Résumé: تعتبر قضية التعامل مع الأسرار الطبية التي يُتوصل إليها بعد إجراء اختبار جيني مسألة حساسة جدًّا، وهذا لوجود مميزات خاصة للمعلومات الوراثية عن غيرها من المعلومات الطبية الأخرى، ولوجود أطراف عديدة تهمها معرفة هذه المعلومات، كالخطيبين اللذين ينويان الزواج بينهما، ومؤسسات التوظيف، وشركات التأمين، وأفراد عائلة الشخص المعني بإجراء الاختبار. لذلك يحاول هذا البحث أن يضع بعض الضوابط الفقهية للتعامل مع هذه الأسرار الطبية، بما يحفظ حق الخصوصية الجينية للفرد، ولا يحرم الأطراف الأخرى من حقها في المعلومة المشروعة. The question of dealing with medical secrets found after a genetic test is very sensitive, because genetic information has special characteristics comparing with other medical informations, and many parties are interested in knowing this information, such as the fiances who intend to be married, employment institutions, insurance companies, and family members of the person involved in the test. Therefore, this research attempts to establish some Jurisprudencial controls to deal with these medical secrets, so that to preserve the individual right of genetic privacy, and not to deprive other parties of their right to legitimate information.
