Résumé: عرفت الأراضي الفلاحية التابعة للدولة تطورا تشريعيا واضحا في مجال استغلالها، بدء من أسلوب الاستغلال الموجه إلى أسلوب الاستغلال الحر ، وأخيرا إلى الامتياز كأسلوب لاستغلالها بموجب القانون 10-03 المؤرخ في 15/08/2010 ، الذي عقد هو الآخر من مشكلة الاستغلال ، و الواضح أن الاشكال لا يطرح في آلية الاستغلال ، بل في فكرة تقييمه لمعرفة الأشخاص الذين تتوفر فيهم صفة الفلاح ، ليتم التنازل لهم بملكية الأرض، أو إيجارها وفق قيمتها التجارية بصيغة المزاد العلني.
