شروط دعوى الإلغاء كآلية رقابية على القرارات الإدارية

Résumé: الملخص تعتبر دعوى الإلغاء وسيلة من وسائل الرقابة القضائية على مشروعية القرارات الإدارية ، بحيث تعد الطعن القضائي الذي يرمي إلى إبطال القرار الإداري غير المشروع من طرف القاضي الإداري ، إلاّ أنه يشترط لقبول دعوى الإلغاء توافر مجموعة من الشروط ، ومن هذه الشروط ما يميّز دعوى الإلغاء عن غيرها من الدعاوى ومنها ما هو مشترك ويجمعها بغيرها ، وتتمثل هذه الشروط في شروط شكلية والتي تتيح لأطراف الدعوى اللجوء للقضاء ومخاصمة القرار الإداري المعيب الذي يمس بمراكزهم القانونية سواء أمام المحاكم الإدارية أو مجلس الدولة والشروط الموضوعية التي بواسطتها يمكن قبول دعوى الإلغاء ومنه إلغاء القرار لإداري المعيب . Résume : Le recours en annulation est considéré comme un moyen de contrôle juridictionnel de la légalité des décisions administratives, car il s'agit d'un recours juridictionnel qui vise à faire annuler la décision administrative illégale par le juge administratif. et ces conditions sont représentées par des conditions formelles permettant aux parties au procès de saisir la justice et de contester la décision administrative défectueuse qui affecte leurs positions juridiques, que ce soit devant les juridictions administratives ou le Conseil d'Etat, et les conditions objectives par lesquelles l'annulation poursuite peut être acceptée, y compris l'annulation de la décision administrative défectueuse. Abstract : The annulment lawsuit is considered a means of judicial control over the legality of administrative decisions, as it is a judicial appeal that aims to nullify the illegal administrative decision by the administrative judge. Of the lawsuits, including what is common and combines them with others, and these conditions are represented in formal conditions that allow the parties to the lawsuit to resort to the judiciary and dispute the defective administrative decision that affects their legal positions, whether before the administrative courts or the State Council, and the objective conditions by which the annulment lawsuit can be accepted, including the cancellation of the defective administrative decision.
