Résumé: بموجب التعديل الدستوري لسنة 2020 استحدث المؤسس الدستوري الجزائري المحكمة الدستورية كهيئة مستقلة وأناط بها مهمة الرقابة على دستورية القوانين وهو اتجاه صريح إلى اعتماد الرقابة القضائية و التخلي تماما عن الرقابة السياسية بواسطة المجلس الدستوري،على الرغم من أنه ظل متأثرا بها،حيث ما زالت عالقة في النصوص التي نظمت المحكمة الدستورية،من خلال وصف قضاة المحكمة الدستورية بالأعضاء وعدم الاعتراف لهم صراحة بصفتهم كقضاة،وكذا اعتبار الإخطار هو وسيله الاتصال بالمحكمة الدستورية.
