Résumé: الملخص: لقد عرف القانون الدولي جدلا حول تطور مصادره بعيدا عن المصادر التقليدية ، فظهرت فكرة وجود مصادر مستحدثة ،تعبر من خلالها أشخاص القانون الدولي عن إرادتها، والتي تعتبر التصرفات الصادرة عن الإرادة المنفردة للدول إحداها، والتي تحتل مكانة بارزة في القانون الدولي نظرا لتعددها واختلاف صورها، مما دفع إلى بروز جدل فقهي حول تحديدها وشروطها ، مع التركيز على طبيعتها القانونية، نظرا للآثار القانونية المترتبة عنها، مما يدفع إلى البحث حول إمكانية اعتبارها مصدرا من مصادر القاعدة الدولية. Abstract: International law has known controversy over the development of its sources away from traditional sources, so that the idea of the existence of contemporary sources has emerged, through which persons of international law express their will, and acts of the unilateral will of States are one of them, which occupies a important place in international law due to its multiplicity and its different forms, This has led to the emergence of a jurisprudential controversy on its definition and its conditions, with an emphasis on its legal nature, taking into account the legal implications thereof, which prompts one to seek the possibility of considering it as one of the sources of international rule.
