التقادم المكسب في الحقوق المشهرة على ضوء الاجتهاد القضائي الجزائري

Résumé: الملخص تجسد القوانين دلالة على عبقرية الصناعة التشريعية، وهو ما يستوجب صياغتها وفق سياسة متناسقة تضمن تحقيق الأهداف، وهو ما يجب احترامه عند وضع قواعد الشهر العقاري، التي جاءت لتطهير العقار، وجعله عنصرا من عناصر الديناميكية الاقتصادية في الجزائر، وقد جاءت هذه الورقة البحثية لتتناول حجية الشهر العقاري، ومدى صحة التقادم المكسب فيه؛ إذ أن هناك عدة آراء في هذه المسألة، وهو ما يستوجب تحليل حجج هذه الآراء وتقدير أصوبها بغية تجويد مضامين القانون العقاري في هذا الموضوع. Abstract :The laws are evidence of the genius of the legislative industry, which necessitates their formulation according to a consistent policy that guarantees the achievement of goals, which must be respected when setting the rules of real estate registration, which came to purify the real estate, and make it an element of the economic dynamism in Algeria. This research paper came to deal with the authenticity of the real estate rights registration, and the validity of the statute of acquisitive prescription in it. As there are several opinions on this issue, which requires analyzing the arguments of these opinions and assessing their soundness in order to improve the contents of the real estate law in this matter.
