الإطار القانوني لتطبيق مقاربة الديمقراطية التشاركية المحلية في الدول المغاربية -دراسة مقارنة بين الجزائر، تونس، والمغرب

Résumé: تتبنى مختلف قوانين الجماعات الإقليمية في الجزائر وتونس والمغرب نظام الديمقراطية التشاركية، لكنها تختلف في آليات تطبيقها وفق قانون كل دولة، ففي تونس يتبنى المشرع مجموعة متعددة من الوسائل الفعالة لتطبيق الديمقراطية التشاركية، أهمها الاستفتاء المحلي والميزانية التشاركية، بينما تقل تلك الفعالية لدى المشرع المغربي، الذي يعتمد أساسا على نظام العرائض، وهذه الآليات غير كافية لدى المشرع الجزائري، الذي يتبنى نظام الاستشارة فقط في قانون البلدية، دون قانون الولاية. The various laws of regional groups in Algeria, Tunisia and Morocco adopt a system of participatory democracy, but they differ in the mechanisms of their application in accordance with the law of each country. In Tunisia, the legislator adopts a variety of effective means of implementing participatory democracy, the most important of which is the local referendum and the participatory budget, while the effectiveness of the Moroccan legislator, which relies mainly on the system of petitions, is insufficient for the Algerian legislator, who adopts the system of consultation only in municipal law, without the law of the municipality.
