شهادة الحيازة كآلية لضمان القروض البنكية The Certificate Of Possession As A Mechanism For Guaranteeing Bank Loans

Résumé: الملخص: منح المشرع الجزائري للمؤسسات المصرفية حق منح قروض بنكية مقابل اشتراط تقديم ضمان لهذه القروض، وتعددت هذه الضمانات بين الضمانات الكلاسيكية المقررة في القواعد العامة، إلى جانب الضمانات المستحدثة ،وأضاف المشرع الجزائري آلية أخرى لضمان القرض البنكي بموجب قانون التوجيه العقاري رقم 90-25 متمثلة في شهادة الحيازة، التي تمنح لصاحبها حق رهن العقار محل شهادة الحيازة، مقابل قرض بنكي بغرض الاستثمار، بالرغم من ان صاحب هذه الشهادة لا يملك هذا العقار وهذا ما يعد خروجا عن القواعد العامة للرهن التي تشترط ملكية العقار المرهون المجسدة بموجب نص المادة 884 الفقرة 02 من القانون المدني ،وإن كان لهذه الشهادة مزايا في تحقيق الثقة والأمان بالنسبة للبنك كونها مشمولة بإجراء الشهر العقاري من جهة، إلا أنها من جهة أخرى تطرح إشكالات عديدة من الناحية العملية خاصة فيما يتعلق بعملية الحجز والتنفيذ على العقار محل شهادة الحيازة. Abstract: the Algerian legislature granting banking institutions the right to grant bank loans in exchange for the requirement to provide a guarantee for these loans, The Algerian legislator has another mechanism to guarantee the bank loan under the Real Estate Directive Law No. 25-90, represented by the Possession Certificate, which grants its owner the right to mortgage the property subject to the possession certificate, in exchange for a bank loan for the purpose of investment, although the owner of this certificate does not own this property and this is what is considered In contravention of the general rules for the mortgage that require ownership of the mortgaged real estate embodied under the text of Article 884 Paragraph 02 of the Civil Code, although this certificate has advantages in achieving confidence and security for the bank as it is covered by the real estate.
