الآثار القانونية لشهادة الحيازة Legal Implications Of A Possession Certificate

Résumé: ملخص: في ظل الافتقار الكبير لعقود وسندات الملكية العقارية الخاصة الذي ميز جزائر ما بعد الاستقلال، حاول المشرع الجزائري حل مشكلات تطهير الملكيات العقارية بعدة آليات قصد توثيق الوعاء العقاري الخاص واستثماره. نصت المادة 39 من القانون 90-25المؤرّخ في18/11/1990المتعلّق بالتوجيه العقاري المعدل والمتمم على آلية تطهير عقاري تتمثل في شهادة الحيازة تسلم من طرف رئيس البلدية المختص إقليميا. لكن الملاحظ أن المشرع العقاري من خلال المادة المذكورة سابقا وما بعدها منح صاحب شهادة الحيازة سلطات كبيرة لا يتمتع بها عادة الا المالك حامل سند الملكية منها الحق في الحصول على رخص البناء والهدم، وتكوين رهون عقارية والحصول على قروض بنكية. Abstract: In light of the great lack of private real estate contracts and bonds that characterized post-independence Algeria, the Algerian legislator tried to solve the problems of clearing real estate properties through several mechanisms in order to document the private real estate base and invest it. Article 39 of Law 25-90 of 11/18/1990 related to the amended and supplemented real estate directive stipulated a real estate cleansing mechanism represented in the possession certificate received by the regionally competent mayor.But it is noticeable that the real estate legislator, through the aforementioned article and beyond, granted the owner of the possession certificate great powers that only the owner who holds the title deed usually enjoys, including the right to obtain building and demolition licenses, form mortgages and obtain bank loans.
