تراجع السيادة التشريعية للبرلمان الجزائري على ضوء التعديل الدستوري لسنة 2016

Résumé: إنّ دراسة العلاقة بين الهيئتين التنفيذية والتشريعية في الجزائر يظهر جليا لنا منح إمتياز واضح لمؤسسة الرئاسة على حساب البرلمان مما أدى لتراجع دوره خاصة على ضوء التعديل الدستوري لسنة 2016. فتحليل الجانب النظري والعملي يوحي بتدخل رئيس الجمهورية في معظم إن لم نقل كل وظائف البرلمان وعبر كل مراحل ممارسة العملية التشريعية , مما أدى إلى إضمحلال دور البرلمان وبروز الحكومة و منحها مكانة ومركز هام ومتميز كشريك أصلي من خلال عدة آليات منحها المؤسس الدستوري لها ،أضف لذلك سلطة رئيس الجمهورية في عرقلة مسار القوانين و إمتلاكه إختصاص التشريع بالأوامر داخل المجال المخصص للبرلمان وتخويله سلطة سن قواعد قانونية توازي التشريع البرلماني وفتح مجال واسع للتنظيم المستقل The study of the relationship between the legislative and executive bodies clearly shows us granting a clear concession to the presidency at the expense of Parliament, which led to a decline in its role , especially in light of the constitutional amendment of 2016. The analysis of the practical and theoretical side suggests the intervention of the President of the Republic in most if not all the functions of Parliament and through all the stages of the legislative process, Which led to the decline of the parliament’s role and the emergence of the government and granting it an important and distinguished position as a genuine partner through several mechanisms granted by the constitutional founder. Legal rules parallels parliamentary legislation and open up ample room for independent regulation.
