دعوى استرداد الحيازة (وفقا لمقتضيات القانون المدني وقانون الإجراءات المدنية والإدارية الجزائريين) Possession Restitution Action In Algerian Civil Law And Civil Procedure Law

Résumé: الملخص تطرقت من خلال هذه الأسطر إلى دراسة دعوى استرداد الحيازة، والتي تعتبر من قبيل الدعاوى التي سطرها المشرع للحائز الذي تمّ الاعتداء على حيازته، باللجوء إلى القضاء لصدّ هذا الاعتداء واسترجاع حيازته. وتعدّ هذه الدعوى من الدعاوى التي يرفعها الحائز الذي فقد حيازته على العقار أو الحق العيني العقاري بالكامل أي أنّ محلّ الحيازة قد خرج من يد حائزه وانتقل إلى المدعى عليه، على أن تكون الحيازة مستوفية لجميع شروطها وموجباتها القانونية حتى يمكن سماع دعوى استرداد الحيازة. Abstract: This paper tackles the action of possession restitution, which is considered by the legislator as one of actions given to the possessor who bear the aggression, by the recourse to the justice in order to stop it and restitute his possession. This lawsuit is one, among others, taken by the possessor who lost its real estate or the entire real property right, so the object of the possession is out of the hands of his possessor and shifted to the defendant possession, provided that the possession is legal and lawful so that the claim of restitution can be heard.
