الأمن القضائي وأثره على المناخ الاستثماري في الجزائر

Résumé: يعد مرفق القضاء إحدى أهم الركائز الأساسية التي تقوم عليها دولة الحق والقانون، فلم يعد دور القضاء مقتصرا على حل النزاعات بين الطرفين المتقاضيين فقط، بل أصبح له دور مهم جدا في تحريك عجلة التنمية نحو الأمام، ولهذا عملت الدولة الجزائرية على إرساء قواعد قضاء تجاري متخصص وإنشاء محاكم تجارية متخصصة، بهدف إصدار أحكام وقرارات قضائية منصفة بين الأطراف المتنازعة والإسراع في حل النزاعات بين المستثمرين، ما من شأنه أن يعزز الثقة لديهم في المنظومة القضائية للدولة المضيفة، فيتحقق بذلك ما يسمى بالأمن القضائي. Elimination facility is a basic pillar to building the state of right and law, where the role of eliminate is not just the dispute resolution, but he has an important rôle in achieving economical development, and for this the state established a specialized commrcial judiciary, and create a specialized commercial courts , with a goal issuing a judicial judgments and decisions witch are equitable for parties to the conflict, and to resolve disputes between investors, what boosts confidence at the investors in the judicial system of the host country, witch lead a realisation of judicial security. key words: eliminate, commercial judiciary, specialized commercial courts, judicial security.
