مبدأ حريـــــــة الاستثمار في التشريع الجزائري

Résumé: إن مبدأ حرية الصناعة والتجارة ذو نهج ليبرالي قائم على حرية المبادرة والمنافسة الحرة، الذي يمنح للأشخاص عدة حريات لكنها ليست مطلقة، لأن القانون جاء بعدّة قيود للمحافظة على نزاهة وشفافية المنافسة في مجال اقتصاد السوق الذي يبنى على نظرية سياسية اليد الخفية (Invisible hand‏) وهي سياسية تنظم السوق ابتكرها عالم الاقتصاد آدم سميث، وإذا كان هذا المبدأ يقضي برفض تدخل الدولة الواسع في المجال الاقتصادي، إلا أن ذلك أصبح واجبا، فتدخل الدولة يجب أن يكون تدخلا فاعلا من أجل الحفاظ على الأهداف السياسية، الاجتماعية والاقتصادية لتحقيق المصلحة العامة من جهة، وحفاظا على المصلحة الخاصة للفرد من جهة أخرى من المنافسة الغير مشروعة، لذلك كرّس المشرّع الجزائري هذا المبدأ بصريح النص في المادة:61 من دستور2020 التي تنص على أن: "حرية التجارة والاستثمار والمقاولة مضمونة، وتمارس في إطار القانون". The principle of freedom of industry and trade has a liberal approach based on freedom of initiative and free competition, which grants individuals several freedoms, but they are not absolute, Because the law came with several restrictions to maintain the integrity and transparency of competition in the field of market economy, which is based on the political theory of the invisible hand, a market-regulating policy invented by the economist Adam Smith. And if this principle dictates rejecting extensive state intervention in the economic field, it has become a necessity, State intervention must be effective in order to maintain political, social, and economic goals to achieve the public interest on one hand, and to protect the individual's private interest from unfair competition on the other hand. Therefore, the Algerian legislator enshrined this principle explicitly in Article 61 of the 2020 Constitution, which states that "freedom of trade, investment, and entrepreneurship is guaranteed and practiced within the framework of the law".
