النموذج القانوني لجريمة تهريب المهاجرين

Résumé: ملخص: تهدف هذه الدراسة إلى توضيح النموذج القانوني لجريمة تهريب المهاجرين، من منظور البروتوكول المتعلق بمكافحة تهريب المهاجرين عن طريق البر والبحر والجو المكمل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية، والقانون رقم 09-01 المعدل والمتمم لقانون العقوبات، وذلك بهدف الوقوف على مواطن الاتفاق والاختلاف بينهما.بحيث سمحت لنا الدراسة من تحديد صفة الجاني في جريمة تهريب المهاجرين وطبيعة السلوك المجرم، والعقوبات المقررة له مع تبيان ظروفها المشددة والمخففة. Abstract: This study aims to clarify the legal model of the offense of smuggling of migrants, in the perspective of the Protocol against the smuggling of migrants by land, air and sea, supplementing the United Nations Convention against Transnational Organized Crime and the law n ° 09-01 modifying and supplementing the penal code, in order to identify points of agreement and disagreement. the study allowed us to determine the adjective of the perpetrator of the offense of smuggling of migrants and the nature of the criminal behavior, and the penalties prescribed for him with an explanation of their aggravating and mitigating circumstances.
