طرق متابعة مقلد العلامة التجارية

Résumé: يتمثل الهدف من دراسة موضوع إجراءات متابعة مقلد العلامة التجارية، تبيان الخطوات العملية التي ينبغي لصاحب العلامة التجارية اتباعها من أجل حماية حقوقه وإبراز الإجراءات الواجب عليه احترامها حتى يتمتع بحقوقه كاملة. فقد نص المشرع الجزائري على أنه يجوز لكل صاحب علامة مسجلة أن يطلب اتخاذ إجراءات تحفظية قبل رفع دعوى التقليد والهدف من ذلك إثبات الاعتداء على حقوقه وذلك مؤقتا إلى أن يتم الفصل في موضوع النزاع. ومن خلال هذا سوف يتم دراسة إجراءات دعوى التقليد والتي تباشر في حالة توافر أحد الأفعال التي تعد بمثابة تعدي على ملكية العلامة أو ترمي إلى خداع وتظليل الجمهور، وتنتهي دعوى التقليد بتوقيع جملة من الجزاءات على من تثبت إدانتهم، وتتنوع هذه الأخيرة بين عقوبات جزائية ومدنية وعقوبات تكميلية. The purpose of the study of the theme of the prosecution procedures of the trademark infringer involves the practical steps that the trademark holder shall follow so that he protects his rights andhighlights the procedures that must be followed in order to enjoy all his rights. The Algerian legislator provides that the trademark holder can request protective measures before starting a lawsuit for counterfeiting in order to prove temporarily the infringement of his rights until having ruled on the merits of the litigation From that point on, we began the study of the prosecution procedures of the counterfeiting thatare initiated in case of existence of one of acts that constitutes an infringement of the brand or aims to dupe and deceive the public. The prosecution is conclude by a set of punishments of the persons who the guilt is established and these last may be criminal of civil oradditional penalties .
