إثبات تقليد العلامة التجارية

Résumé: تهدف هذه الدراسة إلى توضيح الجوانب القانونية الهامة المتعلقة بإثبات تقليد العلامة التجارية، وذلك نظرا لاتساع دائرة تقليدها، حيث أولى المشرع الجزائري أهمية كبيرة لمكافحة هذه الظاهرة وذلك من خلال تجريم أفعال التقليد وتقرير لها جزاءات وحتى يتمكن مالك العلامة من اثبات وقوع اعتداء على حقه في العلامة منحه المشرع سلطة اتخاذ إجراءات تسبق رفع دعوى التقليد، من ذلك إجراء الحجز الذي يعد بمثابة وسيلة اثبات وقوع فعل التقليد، لذا فإنه من الضروري التطرق إلى وسائل اثبات تقليد العلامة التجارية. Abstract : This study aims at clarifying the important legal aspects related to Proving the tradition of the trademark, in view of the breadth of the breadth of its tradition. The algerian legislator gave great importance to combating this phenomenon by criminalizing the acts of imitation and imposing sanction, the marek gave the legislator the power to take action prior to bringing up the counterfeiting case, including holding the seizure as a means of proving the act of imitation, soi t is necessary to address the means of proving the trademark tradition.
