Résumé: إن العقد الطبي في الجراحة التجميلية لا يتعلق بمرض معين، بل بعلاج عيب أو تعديل مظهر عضو من الجسم، فلا يتطلب الاستعجال ويكون الشخص في وضعية طبيعية تجعله يبدي موافقته على إجراء العملية، خصوصا إذا كانت الجراحة تجميلية غير علاجية. إن جراح التجميل يكون التزامه مشددا في جراحة التجميل غير العلاجية، ويكون مسؤولا مسؤولية عقدية إذا توافرت أركانها ولم يتمكن من دفع المسؤولية. لقد شهدت جراحة التجميل في السنوات الأخيرة تطورا كبيرا في كل الدول، ومنها العربية إلا أنها لم تحظ بالاهتمام في القانون الجزائري، على الرغم من الأعداد الهائلة التي خضعت لجراحة التجميل. Medical contract in the field of plastic surgery and the responsibility of the doctor is civil. The medical contract in plastic surgery is not about a specific disease but about the treatment of an anomaly or the modification of a body appearance that does not require urgency. The person concerned is in a normal state and condition that allows him to give his approval to the doctor for completion of the aesthetic surgical act.The plastic surgeon has a strong commitment is aesthetic surgery ; and he is under tort liability in the case he fights to his engagement.The plastic surgery has undergone a worldwide development but Algerian legislation does not lend it a particular interest despite the large number of people having undergone an act of aesthetic surgery.
